Clause 1: Definitions

  The words "The Company", "us", "we", and "our" refer to Muslim Matrimony Network.

  The words "you" and "your" refer to the customer or user who uses this website.

  The word "profile" refers to your detailed biographical information. This information will be used to provide information about yourself and for matchmaking purposes.

  "Site" refers to our website located at www.muslimmatrimonynetwork.org.

  "Content" refers to the information and other material available within the site.

  "This document" refers to the Terms Of Service Agreement for Muslim Matrimony Network.

  "Member" refers to any person registered on www.muslimmatrimonynetwork.org.

Clause 2: Conditions of Membership

  You must first become a registered member bound to the Terms Of Service laid out within this document.

  You must be a Muslim adult who is either Single, Widowed, or Divorced and you must be a resident of the United States Of America or Canada. In addition, you must be at least 18 years of age in order to register.

Clause 3: Registration

  A completed registration form;

  A photograph of yourself for display as part of your member Profile. Your photograph may be sent via e-mail and can be of either ".gif" or " .jpg" format.

  Ensure that the information in your Profile is true and correct;

  Inform us of any change in your personal details or circumstances;

• 3

  Update us of any changes in your contact information at the earliest opportunity so as to ensure the receipt of any notices or communications from us;

  Take measures to ensure your safety when meeting / communicating with other members on the phone, through email, or in person. Your safety is your own responsibility;

  Use our website and services in accordance with the law;

• 6

  Represent and warrant to us that the information provided in your Profile is exclusively authored by you, and that you are the exclusive owner of your photographs. You are solely responsible for the information provided by you in your Profile and we cannot be held liable for any misuse of this information by another member or third party.

  Not transmit to us or other members, any abusive, defamatory, inaccurate, obscene, profane, threatening, harassing, offensive sexually oriented, racially offensive, or illegal material, or any material which infringes upon or violates another party's rights (including, but not limited to, proprietary rights, and rights of privacy).

  Ensure that your Profile does not contain any offensive anatomical or sexual references, or offensive sexually suggestive or connotative language. We will not accept any photos containing nudity. We reserve the right, but are not obligated, to reject any profile or photograph that does not comply with these prohibitions.

  Not advertise to or solicit other members to buy or sell any products or services through the website or through our service. You will refrain from transmitting any chain letters, junk or spam mail or messages to other members. If you do advertise or promote any product or service without our written permission, you agree to pay a standard advertising rate of $500 per day for every day your account has been on www.muslimmatrimonynetwork.org, starting from the day you registered. You are personally liable if we are not able to recover the sum of monies from the company advertised and we will enforce this with legal action.

  Expressly authorize us to disclose any information about you to law enforcement or any other Government Agency, which we, at our sole discretion, consider to be necessary or appropriate in connection with any fraud, intellectual property infringements or other activity which is or may be illegal or may expose us to legal liability.

  Not in any way post, distribute or reproduce any copyrighted material, trademarks, or other proprietary information without first obtaining the consent of the owner of such proprietary rights.

  Not try to access any unauthorised part of the Site.

  It is the sole responsibility of each client to verify any information that they receive about any match, and we and our matchmakers will not be held responsible for any loss or damage that occurs through our service.

  Be authorised by you to display your photograph as part of your member profile and to disclose your chosen methods of contact to other members. You agree to this by using our services and by submitting the registration form;

  Reserve the right to make modifications to our service without giving prior notice;

  Reserve the right to suspend or cancel your membership immediately without refund if your behaviour causes complaint and we deem that complaint to be serious and justified.

  Reserve the right to reject an application for any reason and without providing an explanation.

Clause 6: Reporting Procedure

If you receive via this Site a message or other communication from us or from another member which you believe to be either defamatory, abusive, obscene, profane, threatening, harassing, racially offensive or illegal, or which you consider in any way infringes upon the rights of you or another person (in all cases an 'Offensive Message'), you should:

  Print and retain a hard copy and

  Save a copy of each such Offensive Message in electronic format.

If you intend to take further action in respect of such Offensive Message either by way of complaint to us, the Police or any other regulatory body, you will need to provide copies of any Offensive Messages as evidence.

We confirm that we are not able to store and/or trace every e-mail or other communication passing between us and our members and therefore accept no liability as a result of your receiving the type of communication described in this clause.

Clause 7: Liability

It is the sole responsibility of each client to verify any information that they receive about any match, and we and our matchmakers will not be held responsible for any loss or damage that occurs through our service.

We specifically disclaim any liability for your conduct or any loss or damage arising directly or indirectly from or in any way connected with the Site. Your statutory rights relating to any goods or services purchased through the Site are not affected.

The opinions, advice, statements, offers, or other information or content made available through our service are those of their respective authors and are not ours. We do not guarantee the completeness, usefulness, or accuracy of any information on the service, and neither endorse nor adopt nor are responsible for the reliability or accuracy of any opinion, advice, or statement made. Under no circumstances will we be held responsible for any damage or loss that results from anyone's reliance on information or other content posted on our service, or transmitted to our members.

It is possible that other customers or users (including unauthorised users or 'hackers') may post or transmit offensive or obscene materials on the site and that you may involuntarily be exposed to such offensive and obscene materials.

The maximum liability of us to you in respect to any breach of any terms of this agreement by us shall, in any event, be limited to the amount of the fee paid by you.

Clause 8: Indemnity

You will defend, indemnify, and hold harmless our officers, directors, employees, agents and third parties, for any losses, damages, costs, liabilities and expenses (including legal fees) associated with or arising out of your use of our service, including any breach by you of the terms of this agreement.

Clause 9: Data Protection

Occasionally, we will provide some of your details to other companies so that you may receive information and offers that may be of interest to you. If you prefer that we not pass on your details, then please confirm this in writing to us. In addition, please be informed that the information you provide to us may also pass to countries outside Europe (except for the normal routing requirements of the internet). If you prefer that your details not be passed to countries outside Europe, except in accordance with the eighth Data Protection Principle as laid out in the Data Protection Act 1998, please confirm this in writing to us. Finally, if you would like all direct communication between yourself and the site to be discontinued then please confirm this to us in writing.

Clause 10: Term of Agreement

This agreement will be sustained for successive fixed periods of 12 months unless either you or we have given the other at least 28 days' prior written notice of termination to take effect at the end of any such fixed period.

We reserve the right to terminate the agreement immediately if you breach any term of this agreement.

Clause 11: Provision of service

  It is technically impossible to provide a Site free of faults and that we do not endeavor to do so.

  Faults may result in the Site becoming temporarily unavailable.

  The Site's operation may be adversely affected by conditions and performances outside our control, including, but not limited to, transmission and telecommunications links between us and you and between us and other systems and networks.

  We and our suppliers reserve the right to make modifications and/or changes to the Site at any time.

  While it is our endeavor to perform our services with reasonable care and skill, there is no representation or warranty that the services will be without interruption or free from errors or that all errors or defects can be corrected or remedied.

  We will not be held responsible for any damage or loss sustained or incurred by any third party (including, but not limited to, any loss of use of any software or equipment, or loss of or spoiling of any data) that results from any defect, deficiency or error in any equipment or software or any associated documentation, or for any failure or interruption of any telecommunications facilities or network systems which is outside of our control.

  Furthermore, you acknowledge that some of the Content is supplied to us (directly and indirectly) by third parties and as a result we can not offer any warranty of any nature in relation to such Content.

We specifically disclaim any liability for any temporary or permanent unavailability of the Site arising from events of any kind or circumstances which are beyond our control (Force Majeure) even though we shall reasonably endeavor to minimize or mitigate the effects of any such force majeure. However, this does not release you, by reason of such force majeure, from being obligated to indemnify or make any payment due under these Terms and Conditions.

You are using our website at your own risk. We specifically disclaim any liability for any loss or damage to your hardware or software resulting from your access to or use of the website.

Clause 12: Links

This Site may contain hyper links to other websites. Some products and services offered by us are through third party companies that provide additional products and services for and on our behalf. By using any of these third party companies, you agree to be bound by, and comply with, their terms and conditions. These third party companies are neither our associates nor parts of our Company and we shall not be liable under any circumstances for any losses or damages caused by a third party company. This limitation also applies in respect to damages incurred by reason of other goods or services received through a recommended third party company. If you decide to accept any products or services offered by a third party company, then all communication must be between you and the third party company. We will neither be responsible nor accept any liability for any communication or misrepresentation of the third party company.

You acknowledge and agree that you use these links at your own risk and that we accept no responsibility for the availability of such external sites. Furthermore, we do not endorse and do not accept any responsibility or liability for any content, advertising, products or other materials on or available from such sites.

Clause 13: Intellectual Property and Use of Software

  Cause disruption to or interfere with any Service or any site, servers or networks service or site.

  Interrupt, destroy, or limit our fundamental computer software, hardware, or telecommunications equipment by posting, emailing or otherwise transmitting any material that contains software or other computer code, files, or programs.

  Forge headers or manipulate identifiers in other ways for the purpose of disguising information transmitted through the Service.

  "Mirror" or "Frame" any part of our Service.

  Direct anyone to another website using meta tags or code or other devices containing any reference to us or the Site connected to the Service.

  Modify, adapt, sub license, translate, sell, reverse engineer, decipher or otherwise disassemble any part of the Service or software used for the Service or assist others in doing so.

Clause 14: Security

You are solely responsible for maintaining the security of your user name and password that you use to access the Site and you must take all necessary steps to safeguard their confidentiality, and ensure that they are used properly and that they are not disclosed to unauthorized people. Furthermore, you agree to notify us immediately if you believe that your user name or password has been or is likely to be compromised. We uphold our right to suspend access to the Site if we believe that security has been, or is likely to be, breached and we may require you to change your passwords. Promptly contact us if you forget or lose your user name or password.

Clause 15: Personal Information Policy

During registration, we gather your Personal Information and use this information to operate the Site and keep you updated about new features of the Site. On occasion, your Personal Information may be used by us to inform you of new services and products from us. In addition, we may choose to provide your Personal Information to carefully selected third parties. If you would rather not receive such information from us or directly from other suppliers, then please inform us in writing. Please review and update your Member Profile regularly to ensure that your Personal Information is up-to-date. If you would like us to delete the Personal Information that we hold about you, please inform us via email. If you believe that we have not adhered to the principles stated above, please notify us via email and we will attempt to use all commercially reasonable methods to determine and correct the problem.

Clause 16: Events

On occasion, we may choose to organize and hold social events. However, we offer no guarantee as to the number of social events that we will organize (if any), nor the number of compatible introductions offered or made to you. Invitations to attend and purchase tickets for such events will be solely at our discretion and will be subject to the terms and conditions of attending events, which we will make available in writing.

Clause 17: Miscellaneous

This agreement constitutes the entire agreement between the parties with respect to Advertisements and can only be modified in writing and signed by both parties. We reserve the right to assign the benefit (subject to the burden) of this agreement to any purchasers of our business.

These terms and conditions do not affect your statutory rights.

This Agreement will be governed by and interpreted according to the laws of the United States, and any dispute will be dealt with in the United States courts.

Each party affirms that, except as expressly laid out in this agreement, no term of this agreement can be enforced under the Contracts (Rights of Third Parties) Act 1999 by any third party who but for that Act would not have been entitled to enforce such terms.

Clause 18: Copyright Notice

All of the material on this Site, including but not limited to, site design, text, graphics, user interfaces, software, and their selection and arrangements are © 2014 Muslim Matrimony Network, and you must only utilize such material in the ways authorized by the copyright owner.

Clause 19: All Rights Reserved

The content within this Site is for your personal use only. You are allowed to download the content onto only one computer hard drive. You agree not to copy, distribute, transmit, reproduce, publish commercially, exploit, or create derivative works from the Content, or enable others to do so

Muslim Matrimony Network strictly prohibits the use of any materials on this website without first obtaining our written permission.
